West Seneca Zoning Board of Appeals Meeting Minutes 01/26/2005
The regular meeting of the Zoning Board of Appeals of the Town of West Seneca was called to order by Chairman Joseph Kleinfelder on January 26, 2005 at 7:00 PM, followed by the Pledge of Allegiance. ROLL CALL: Present -

Motion by Mr. Dunn, seconded by Mrs. Price, to open the Public Hearing.
APPROVAL OF PROOFS OF PUBLICATION: Motion by Mrs. Price, seconded by Mr. Dunn, to approve the proofs of publication and posting of legal notice.
APPROVAL OF MINUTES #2004-10: Motion by Mrs. Price, seconded by Mr. Dunn, to approve Minutes #2004-11 of December 8, 2004.
TABLED ITEM: 2004-106 Request of Benderson Dev Co., Inc. for a variance for property located at 2802 Transit Road to erect pylon sign to replace existing sign over allowable size.
Motion by Mr. Dunn, seconded by Mrs. Price, to remove this item from the table.
Tom Wandtke, 570 Delaware Avenue, submitted letters from National Fuel Gas, 2850 Transit Rd, LLC, and 10 Dyke Road Inc., stating no objection. Mr. Wandtke also submitted a sketch of the revised sign which was reduced in size to 15 ft high, with the roof 1.7 ft and polls covers at 1.4 ft in width. Every portion of the sign, except the actual “Storage Pros” section and menu board has been reduced. Motion by Mr. Dunn, seconded by Mrs. Price, to close the public hearing and grant a variance for property located at 2802 Transit Road to erect pylon sign, pursuant to the revised plan submitted January 26, 2005, to replace existing sign over allowable size.
NEW BUSINESS: 2005-001 Request of Philip & Mary Ann Desmone for a variance for property located at 402 Union Road to erect house 7 ft 6 in into rear yard setback and 1 ft into front yard.
Philip and Maryann Desmone submitted letters from residents of adjoining properties, 418 Union Road and Mr. Thorton on Reserve Road, stating no objection. Mr. Desmond stated his request is to extend the patio 7ft into the setback on the Union Road side of the property. He also needs to extend 1 ft into the front yard setback. Mr. Czuprynski stated the 1 ft setback is actually for the exterior side yard, rather than the front yard setback. Motion by Mrs. Price, seconded by Mrs. Rosenswie, to close the public hearing and grant a variance for property located at 402 Union Road to erect house 7 ft 6 in into the rear yard setback and 1 ft into the exterior side yard, based on the odd size of the lot.
