Supervisor Sheila M. Meegan called the meeting to order at 7:00 P.M. with 30 seconds of silent prayer followed by the Pledge of Allegiance to the Flag led by Chief Daniel Denz.

Supervisor Meegan read the Fire Prevention Code instructing the public where to exit in case of a fire or an emergency.
The meeting was dedicated to the memory of Mary Bowers, Robert Niederpruem Sr., Esther Starkey, and the 19 Arizona firefighters that were killed in the line of duty fighting the wildfires.
15-A MINUTES TO BE APPROVED
· Motion by Supervisor Meegan, seconded by Councilman Rusinski, to approve Minutes #2013-14 of June 24, 2013.

· Motion by Supervisor Meegan, seconded by Councilman Rusinski, to approve minutes from the May 31, 2013 bid opening for disposal of non-hazardous solid waste.

· Motion by Supervisor Meegan, seconded by Councilman Hart, to approve minutes from the July 2, 2013 bid opening for 2013 Phase 2 & 3 Sanitary Sewer Rehabilitation.

1. Supervisor Meegan re Appointment of Matthew Hourihan as Laborer full time

Motion by Supervisor Meegan, seconded by Councilman Rusinski, to terminate Matthew Hourihan as part-time Recreation Attendant and appoint Matthew Hourihan as full-time Laborer in the Buildings and Grounds Department effective July 9, 2013 at an annual salary of $40,019.20 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

Motion by Supervisor Meegan, seconded by Councilman Hart, to appoint Lauren Masset as part-time Clerk effective July 8, 2013 at a rate of $10 per hour and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

3. Supervisor Meegan re Budgetary transfer request

Motion by Supervisor Meegan, seconded by Councilman Hart, to approve a budgetary transfer request of $8250 from Contingency Acct. #1.1990.0480 to Library Repairs & Maintenance Acct. #1.7410.0445 for the town’s share of the 2011-2012 library grant for sidewalk replacement.

5. Town Attorney re Bid award for disposal of non-hazardous solid waste

Motion by Supervisor Meegan, seconded by Councilman Hart, to award the bid for disposal of non-hazardous solid waste generated within the Town of West Seneca to Modern Landfill, Inc., 3675 Jeffrey Blvd., Blasdell, NY 14219 at their low bid amount of $37.25 per ton meeting specifications and effective August 5, 2013.

On the question, Councilman Hart questioned if mileage was factored in.
Town Attorney Shawn Martin responded mileage, time and price per ton were all considered in the overall cost.

5. Town Engineer re Bid award for 2013 Phase 2 & 3 Sanitary Sewer Rehabilitation Project

Motion by Supervisor Meegan, seconded by Councilman Rusinski, to award the bid for the 2013 Phase 2 & 3 Sanitary Sewer Rehabilitation Project to United Survey Inc., 25145 Broadway Ave., Cleveland, Ohio 44146 at their low bid amount of $4,884,040 noting that funding for this project is through the $30 million bond for sewer rehabilitation.

6. Chief Denz re Appointment of Anthony R. Andolina as Police Officer

Motion by Supervisor Meegan, seconded by Councilman Rusinski, to appoint Anthony R. Andolina as Police Officer effective July 9, 2013 at an annual salary of $45,470.38 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

On the question, Councilman Hart questioned if Officer Andolina had to be reachable on the current civil service list.
Supervisor Meegan stated Mr. Andolina was a police officer with the City of Salamanca and this is a lateral move approved by Erie County Personnel. She further noted that Officer Andolina personally paid for his attendance at the police academy.

7 & 8. Chief Denz re Status change for part-time Public Safety Dispatcher James McCullough & Norman Brem to seasonal

Motion by Supervisor Meegan, seconded by Councilman Rusinski, to change the status of part-time Public Safety Dispatchers James McCullough and Norman Brem to part-time seasonal effective July 1 - 31, 2013 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

9. Town Clerk re West Seneca Public Library annual yard sale

Motion by Supervisor Meegan, seconded by Councilman Hart, to approve the request of the Friends of the West Seneca Public Library to hold their annual Yard Sale on property adjacent to the West Seneca Public Library along Union Road and Legion Drive on Saturday, August 17, 2013 from 9:00 A.M. to 3:00 P.M.

10. Town Clerk re Annual Tour de Farms

Motion by Supervisor Meegan, seconded by Councilman Hart, to approve the request from Massachusetts Avenue Project to allow their Annual Tour de Farms bicycle ride through West Seneca on September 14, 2013.

On the question, Councilman Hart questioned if the Police Department had to provide security for the event. Chief Denz responded that only an escort is provided through intersections in town for safety purposes.

11. Code Enforcement Officer re Electronic message board at 950 Union Road

Motion by Supervisor Meegan, seconded by Councilman Rusinski, to approve an electronic message board at 950 Union Road.

On the question, Councilman Hart questioned the location and if this is a new sign.
Code Enforcement Officer John Gullo responded the old sign will be replaced by a new sign in the same location.

12. Code Enforcement Officer re Electronic message board at 1956 Ridge Road

Motion by Supervisor Meegan, seconded by Councilman Hart, to approve an electronic message board at 1956 Ridge Road.

On the question, Supervisor Meegan asked Code Enforcement Officer John Gullo to contact the adjacent property owner and request removal of the metal sign on their property that is deteriorated.

13. Director of Recreation re Budgetary transfer request

Motion by Supervisor Meegan, seconded by Councilman Hart, to approve a budgetary transfer request of $4000 from School Intervention Acct. #1.7140.0472 to Pool Supervisor Acct. #1.7180.0100 to cover the pay rate change for the pool supervisor.

14. Highway Supt. re Budget amendment request

Motion by Supervisor Meegan, seconded by Councilman Hart, to approve a budget amendment increasing CHIPS Program Expenditures #002.5112.0201 and State Aid-CHIPS Program #002.3501 in the amount of $86,049.

On the question, Councilman Hart questioned if this was the total amount received for CHIPS.
Highway Supt. Matthew English responded this amount represents only the increase that came from Senator Gallivan’s office.

Motion by Supervisor Meegan, seconded by Councilman Rusinski, to terminate Nicholas Cavalieri as part-time seasonal laborer in the Highway Department effective July 8, 2013 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

16. Senior Recreation Therapist of Senior Services re Appointment of Brian Osieja as part-time Recreation Attendant

Motion by Supervisor Meegan, seconded by Councilman Hart, to appoint Brian Osieja as part-time Recreation Attendant at the senior citizens fitness center effective July 9, 2013 at a rate of $15 per hour and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

On the question, Councilman Hart encouraged residents to take advantage of the gym facilities and programs held at the senior citizens fitness center.
Supervisor Meegan commented on some currently offered programs such as silver sneakers, 55 and alive, yoga and tai chi and suggested holding an open house at the senior center.

15-D APPROVAL OF WARRANT
Motion by Supervisor Meegan, seconded by Councilman Hart, to approve the vouchers submitted for audit, chargeable to the respective funds as follows:
General Fund - $246,361.71; Highway Fund - $44,310.25; Special Districts - $5,526.28; Pre Paid - $4,952.45 (voucher #’s 78776-79134); Trust & Agency Fund - $37,496.48 (voucher #’s 79114-79332); Capital Fund - $66,467.67 (voucher #’s 79000-79237)

ISSUES OF THE PUBLIC
STATUS OF AMERICORPS PAYMENTS
Karen Lucachik questioned the status of AmeriCorps payments.
Finance Director Laura Landers responded that a payment was received for this month.
CAR TRANSPORT VEHICLE PARKING ON RIDGE ROAD
Karen Lucachik commented on a car transport vehicle frequently parked on property adjacent to the new barbeque restaurant on Ridge Road.
Code Enforcement Officer John Gullo responded he will look into it; however, parking for this type of vehicle is allowed since it is a commercial lot.
NYSEG STREET LIGHT REPAIRS
Karen Lucachik commented on NYSEG’s poor service and slow repair time regarding street lights and questioned if the town can do anything to improve the service.
Supervisor Meegan responded that several attempts have been made through phone calls and letters. State, county and local representatives were also contacted. Other municipalities are experiencing similar problems with NYSEG and she suggested the residents contact their congressman, senator and assemblyman to request their assistance.
UNPAID PROPERTY TAXES
Beverly Leising questioned the number of unpaid property taxes in town.
Councilman Hart noted that town taxes are guaranteed and the town is paid in whole by February 15.
Mrs. Leising stated she was questioning if there are residents that have not paid their individual property taxes.
Town Clerk Jacqueline Felser responded this information was forwarded to the county last Friday and suggested Mrs. Leising contact her tomorrow for an exact figure for unpaid taxes.

STATUS OF FORECLOSED PROPERTIES
Beverly Leising questioned if any progress has been made holding banks accountable on foreclosed properties.
Code Enforcement Officer John Gullo responded they have had progress on property maintenance issues such as grass cutting and those costs are being added to the tax bill.
Supervisor Meegan stated six homes in complete foreclosure have been submitted to the legislature and they are continuing to take aggressive action and work with the Senator’s office regarding this issue. This will be a topic of discussion at the August 5th work session.
GARBAGE TOTES
Beverly Leising questioned if a price has been decided on for the totes.
Town Attorney Shawn Martin responded that bids were opened earlier today, but he had not reviewed them to determine whether the many aspects of the specifications have been met.
CONTRACT FOR DISPOSAL OF NON-HAZARDOUS SOLID WASTE
Beverly Leising questioned if the contract awarded to Modern Landfill for disposal of non-hazardous solid waste is the same company that has been doing the work.
Town Attorney Shawn Martin responded this is not the same company as previous years.
ENTRANCE TO FISHER COURT
Johanna Guenther referred to her suggestion at the last Town Board Meeting that Joann and Richard Sharples be recognized in the Bee for planting flowers at the entrance to Fisher Court and stated her disappointment that nothing was included in the paper.
BATHROOMS AT SENIOR CENTER
Johanna Guenther commented on the poor condition of the ladies room at the senior citizens center including ceiling leaks and the need for higher toilets.
Supervisor Meegan responded this was discussed at the work session earlier today and they are conscious of the problem; however, this is not a budgeted item and they are not in a position to replace toilets at this time. Supervisor Meegan noted that over half a million dollars has been spent on improvements in the kitchen, added parking and lighting. If HUD money is available, remodeling of the bathroom will be put on the list.

BATHROOMS AT SENIOR CENTER
Mrs. Guenther commented on the odor outside the ladies room due to the lack of a fan or vent.
Highway Supt. Matthew English responded this was the first he had heard of an odor and he will look into it.
Councilman Hart questioned the possibility of higher toilets.
Mr. English responded that part of the wall would have to be knocked out for plumbing access.
GARBAGE PICKUP
Johanna Guenther stated she would like the town to assist elderly people that are unable to take garbage out to the road.
