Supervisor Sheila M. Meegan called the meeting to order at 7:20 P.M. with 30 seconds of silent prayer followed by the Pledge of Allegiance led by the Quinlivan Family.

On the question, Councilman Hart asked that Item #2 under Communications be clarified to include that the request for qualifications is for a Clerk of the Works who will perform duties as construction inspector on the Community Center Project.

Supervisor Meegan stated the public hearing is cancelled as they will not be overriding the tax cap.

1. Supervisor Meegan re Designation of Halloween
|

Motion by Supervisor Meegan, seconded by Councilman Hanley, to designate Monday, October 31, 2016 between 6:00 P.M. and 8:00 P.M. as the official night for trick-or-treat, noting that residents are asked to please leave their porch lights on to provide lighting and safety for the children and drivers are urged to use extra caution.
On the question, Supervisor Meegan noted that Southgate Plaza is no longer holding the Halloween Parade, but the Recreation Department will once again be holding the Enchanted Path this year on Friday, October 28th.

2. Supervisor Meegan re Erie County Community Development Block Grant

Motion by Supervisor Meegan, seconded by Councilman Hanley, to adopt the following resolution concerning the Erie County Community Development Block Grant (ECCDBG) project requests:
|
WHEREAS, following the Public Hearing of September 19, 2016 that was held at West Seneca Town Hall for suggestions from the public for Community Development Block Grant projects to be submitted for funding;
NOW, THEREFORE BE IT RESOLVED, the West Seneca Town Board submits the following projects to be considered for funding by the Erie County Community Development Block Grant Program during the 2016-2017 grant cycle:
1st Priority - Milling & Resurfacing Project for Boncroft Drive, Bellwood Avenue, Thorndale Avenue and Tindle Avenue which are in CDBG-eligible areas, requesting $123,759.24;
2nd Priority - Modifications to West Seneca Town Hall to provide handicapped accessibility to the Assessor’s Office, Engineering Department and Town Clerk’s office, requesting $150,000;
BE IT FURTHER RESOLVED, the West Seneca Town Board authorizes Supervisor Sheila M. Meegan, to sign, submit and execute a contract with Erie County Community Development Block Grant (ECCDBG) Program for the cited projects upon approval of the ECCDBG; and
BE IT FURTHER RESOLVED, the West Seneca Town Board provides a 25% match of $41,500 for the 1st Priority Project using force labor from Acct. #002.5110.0144; and
BE IT FURTHER RESOLVED the West Seneca Town Board provides a 50% match of $150,452 for the 2nd Priority Project from General Fund fund balance.

4. Town Attorney re Creation of Clearview Estates Lighting District

Motion by Supervisor Meegan, seconded by Councilman Hart, to schedule a public hearing on November 7, 2016 at 7 P.M. to hear all persons interested in the creation of Clearview Estates Lighting District.

On the question, Councilman Hart questioned how this will be funded and why the developer would not pay the cost up front and then create the lighting district. Town Engineer Steven Tanner responded the lights are installed by the developer. The cost is for NYSEG to hook up the lights to electric and creating the special district will then allow the town to tax the residents for that cost along with ongoing annual electric costs.

8. Highway Sup’t. re Appointment of Steven Amoia, Jr. as full-time sanitation laborer

Motion by Supervisor Meegan, seconded by Councilman Hanley, to terminate Steven Amoia, Jr. as part-time Sanitation Laborer and appoint him full-time Sanitation Laborer at a rate of $18.65 per hour effective October 25, 2016, contingent upon the passing of drug and alcohol testing and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

Motion by Supervisor Meegan, seconded by Councilman Hanley, to authorize Detective Lieutenant Kevin Baranowski and Detectives Robert Bebak and Kenneth Morano to attend the NYS Arson Investigators Seminar, November 2 - 4, 2016 at the NYS Academy of Fire Science in Montour Falls, New York, noting the training is required to maintain their certificates as arson investigators and the total cost should not exceed $700.

ISSUES OF THE PUBLIC
ACQUISITION OF MILITARY TANK
James Manley stated five years ago the Town of West Seneca and West Seneca Veterans Committee embarked on a joint mission to obtain an obsolete piece of military hardware to place in Veterans Memorial Park. He recently received a call from Congressman Higgins’ office that the army has a 58 ton M60A3 tank available. The tank is currently located at a VFW Post in Hannibal, New York. It is ready to be picked up if the town wants to take custody of it and Mr. Manley has found someone to move it. He also has an Air Force engineer and apprentices to construct a 35’ x 15’ concrete pad that is needed for placement of the tank. There may be some cost to the town.
Town Engineer Steven Tanner stated he submitted the tank specifications to a structural engineer and it was determined that 12” of sub base stone and 12” of concrete will be required for the pad. The cost will be approximately $50,000 to $55,000 for a contractor to install it.

ACQUISITION OF MILITARY TANK (continued)
Supervisor Meegan questioned where the tank will be located, noting there is a plan to add a stairwell to the north end of Town Hall.
Mr. Manley explained the planned location for the tank, noting the tank must be moved within the next few weeks and the concrete pad must be in place prior to that.
Councilman Hart expressed concern that the tank could interfere with the community center project that will be starting shortly.
Councilman Hanley suggested checking with Buildings & Grounds Supt. Steven Amoia to determine where the electricity comes into the building.
Mr. Tanner stated the underground electrical was located as part of the community center project and most of it is on the opposite side of the path and not near the proposed location for the tank.
Supervisor Meegan commented on the timing for taking possession of the tank with the community center starting and stated she will call the County Executive in Hannibal to see if anything can be done to hold off temporarily.
Motion by Supervisor Meegan, seconded by Councilman Hart, that the town will explore the opportunity to obtain the tank offered by Congressman Higgins’ office, noting there are concerns with the timing, placement and cost involved, and once these issues are resolved the town hopes to be in a position to move forward.

Supervisor Meegan further noted a portion of Union Road will be renamed Veteran’s Memorial Highway in a ceremony to be held in front of Town Hall, November 10th at 10 A.M.

WEST SENECA DEVELOPMENTAL CENTER SURVEY
Supervisor Meegan referred the public to the town’s website and invited them to complete a survey on what they would like to see happen at the West Seneca Developmental Center site. Completed surveys should be forwarded to Assemblyman Michael Kearns’ office.

READY ERIE PREPAREDNESS APPLICATION
Supervisor Meegan announced that Erie County recently launched the Ready Erie Preparedness application which encourages the public to develop a family emergency evacuation plan and directs them to the nearest emergency shelter. The application can be downloaded from Erie County’s website www.erie.gov.
BERG ROAD BRIDGE
Supervisor Meegan questioned when the Berg Road bridge will be open. Highway Supt. Matthew English stated he will call tomorrow to find out and report back to Supervisor Meegan who will put the information out on the Code Red system.
DESIGN STANDARDS ADVISORY COMMITTEE
Senior Code Enforcement Officer John Gullo stated the Design Standards Advisory Committee will hold an informational session at 5 P.M. on November 7th followed by a public hearing at the regular Town Board meeting.
CODE ENFORCEMENT UPDATES
Senior Code Enforcement Officer John Gullo stated he recently received notification from the Insurance Service Office (ISO) that his department’s Building Code Effective Grading is a #4 classification, which is an improvement from the previous #5 classification. He was also recently invited to and attended a National Firefighter Conference in Nashville to speak on how code enforcement should work with firefighters and law enforcement. Mr. Gullo will also be attending the upcoming National Fire Protection Association conference in Orlando to speak on the same topic.
BID DATE FOR SEWER DISTRICT 6 SEWER MAIN REPAIR
Town Engineer Steven Tanner commented on a situation at Plant 6 with sinkholes forming and stated the deficiencies need to be addressed. The cost is estimated at $95,000 and he will be preparing contract documents for the work.
Motion by Councilman Hart, seconded by Supervisor Meegan, to set a bid date of November 17, 2016 at 2:00 P.M. for receipt of bids on the sewer main repair project at Plant 6 in Sewer District 6.

Youth Service Coordinator Lauren Masset stated the Halloween Enchanted Path event will be held Friday, October 28th, 6 P.M. to 8 P.M. at the ball diamond in Veterans Memorial Park.

LEAF PICKUP
Highway Supt. Matthew English stated leaf pickup will begin Monday in Zone 1 (northwest quadrant of the town) and information will be posted weekly on the town sign.
PARKING BAN
Chief Denz stated the parking ban will go into effect beginning November 15th at 1 A.M.
ELECTRONICS RECYCLING EVENT
Councilman Hanley commented on the electronics recycling event sponsored by Senator Gallivan that was recently held and stated six tractor trailers were filled, which saves the town the cost of recycling this equipment. He thanked the police for helping with traffic and Highway Department for the barricades.
INDUSTRIAL & COMMERCIAL INCENTIVE BOARD
Councilman Hart announced the next meeting of the Industrial & Commercial Incentive Board is scheduled for Wednesday, November 2nd at 7 P.M. at the Burchfield Center.
STAR LEGISLATION
Assessor Kandace Wittmeyer requested that the board members encourage Senator Gallivan and Assemblyman Kearns to repeal the new STAR legislation.
EXECUTIVE SESSION
