Supervisor Sheila M. Meegan called the meeting to order at 7:00 P.M. with 30 seconds of silent prayer followed by the Pledge of Allegiance led by Matthew Poole.

Supervisor Meegan read the Fire Prevention Code instructing the public where to exit in case of a fire or an emergency.
Supervisor Meegan recognized Rachel Baksa, a resident and foster parent who started Luggage with Love of WNY along with Carla Morazo and Natalie Schaeffer. The purpose of the project is to provide gently used luggage for children in foster care to transport their belongings. Luggage with Love is partnering with Hope Project of WNY, an organization that provides clothing to foster children. They are also looking for a partner to donate stuffed animals and/or blankets for the children. Donations are being accepted at Town Hall.

19-B HELD OVER PUBLIC HEARING
1. Re: “A PUBLIC HEARING TO CONSIDER A REQUEST FOR A SPECIAL PERMIT FOR PROPERTY LOCATED AT 4592 SENECA STREET, BEING PART OF LOT NO. 223, CHANGING ITS CLASSIFICATION FROM R-50 TO R-50(S), FOR 31 DETACHED SINGLE FAMILY PATIO HOMES WITH ATTACHED GARAGES AND 14 TWO-UNIT TOWNHOMES” in the Town of West Seneca.
The petitioner requested the public hearing be tabled until the next meeting.

1. Town Attorney re Agreement with West Seneca PBA
|

Motion by Supervisor Meegan, seconded by Councilman Hanley, to approve the attached Memorandum of Agreement (MOA) between the Town of West Seneca and the West Seneca Police Benevolent Association, Inc. (PBA), noting the new collective bargaining agreement will include the terms of the expired collective bargaining agreement between the PBA and the town and the modification of the terms of the attached MOA.

2. Town Engineer re Request for qualifications from potential bidders on Community Center Project

Motion by Supervisor Meegan, seconded by Councilman Hart, to authorize Town Engineer Steven Tanner to release a Request for Qualifications from firms interested in bidding on the Community Center Project with a qualification due date of November 15, 2016.
|
On the question, Councilman Hart stated the Clerk of the Works oversees all aspects of a project (i.e. interprets blueprints; ensures the contractor is doing things properly). Daily updates regarding any changes will be provided and construction meetings will be held bi-weekly.

3. Sr. Code Enforcement Officer re Purchase of disaster preparedness vehicle

Motion by Supervisor Meegan, seconded by Councilman Hanley, to authorize the purchase of a 2017 Chevy pickup truck from Cappellino Chevrolet, 9000 Boston State Road, Boston, NY, at the NYS Municipal rate of $13,971.09, noting this purchase includes trade-in of the current 2009 Ford F-150 disaster preparedness vehicle and funds are available in Line Item #001.3620.0200.

4. Town Justices re JCAP application

Motion by Supervisor Meegan, seconded by Councilman Hart, to authorize submission of the Justice Court Assistance Program (JCAP) grant application to the NYS Unified Court System in the amount of $1,481.91, noting funds will be used to purchase a television and DVD player for the conference room, a DVD player for the courtroom and eight chairs for the conference room.

5. Senior Recreation Therapist of Sr. Services re Status change for p/t clerk typist Janet Kropczynski

Motion by Supervisor Meegan, seconded by Councilman Hart, to change the status of part-time clerk typist Janet Kropczynski to part-time seasonal effective October 11 – November 11, 2016 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

Motion by Supervisor Meegan, seconded by Councilman Hanley, to change the status of part-time Public Safety Dispatcher Kevin Pryzbyl to part-time seasonal effective October 1 - 31, 2016 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

8. Sr. Code Enforcement Officer re Bid award for demolition of three structures

Motion by Supervisor Meegan, seconded by Councilman Hart, to award a contract in the amount of $35,200 to Hannah Demolition, 205 Baitz Avenue, Buffalo, NY 14206 for demolition of three structures, noting Hannah Demolition was the low bidder and they have successfully completed numerous demolition projects in town.

9. Supervisor Meegan re Termination of Brandon Sedlacek

Motion by Supervisor Meegan, seconded by Councilman Hart, to terminate Brandon Sedlacek as laborer effective October 3, 2016 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

10. Town Attorney re Public hearing on Local Law No. 13 of the year 2016 - Tax Levy Limit Override

Motion by Supervisor Meegan, seconded by Councilman Hart, to schedule a public hearing for October 24, 2016 at 7 P.M. to hear all persons interested in Local Law No. 13 of the year 2016, a local law to override the tax levy limit established in General Municipal Law Section 3-c.

Motion by Supervisor Meegan, seconded by Councilman Hart, to approve the vouchers submitted for audit, chargeable to the respective funds as follows: General Fund - $377,879.29; Highway Fund - $112,967.06; Special Districts - $32,156.94; Capital Fund - $146,261.75 (vouchers 95889-96447) Trust - $247,602.35 (vouchers 96426-96460)

Supervisor Meegan read the attached proclamation in recognition of and designating October as Breast Cancer Awareness month.

PRESENTATION OF COMMUNICATIONS BY BOARD MEMBERS AND DEPARTMENT HEADS
HARLEM ROAD EMERGENCY ACCESS
Senior Code Enforcement Officer John Gullo referred to the Harlem Road bridge reconstruction and asked that correspondence be sent to NYSDOT requesting that the temporary access road to the creek remain after the project is completed, noting it would be extremely helpful for emergency vehicles and ice excavation equipment.
RECREATION DEPARTMENT UPDATES
Youth Service Coordinator Lauren Masset stated men’s open gym at East Middle School is cancelled until further notice due to a flooding problem. Updates will be posted on the Recreation Department’s Facebook page. Alternate locations for upcoming activities are being explored. The annual Enchanted Path will be held Friday, October 28th from 6 P.M. until 8 P.M. on the 90’ baseball field at Veterans Park. Current program fliers are available in the Town Clerk’s Office and Recreation Department.
SENIOR CENTER HEALTH AND SERVICES FAIR
Senior Recreation Therapist of Senior Services Mary Josefiak announced a Health and Services Fair will be held on Friday, October 21st from 9 A.M. until noon at the senior center. Health insurance providers will be on hand to inform seniors about changes to health insurance programs. Flu shots and blood pressure screening will also be offered.
PUBLIC EVENTS
Chief Denz announced a Drug Drop Off event on Saturday, October 22nd from 10 A.M. until 2 P.M. at the senior center. Senator Patrick Gallivan is also sponsoring an electronics recycling event at East Senior High School on the same day.
UPCOMING MEETINGS
Councilman Hart announced the Industrial Incentive Board and Design Standards Committee will meet Wednesday, October 5th at 7 P.M. at the Burchfield Center. A training session was held last week for Planning & Zoning Board members with discussion on the Comprehensive Plan and Tree Ordinance. The Planning & Zoning Boards also offered input on design standards.
2017 BUDGET HEARING
Supervisor Meegan announced the 2017 budget hearing will be held October 24th at 5 P.M. followed by the regular Town Board meeting at 7 P.M.

ISSUES OF THE PUBLIC
EAST & WEST ROAD WATER PROJECT
Sam Kreuzer questioned the status of the East & West Road water project.
Councilman Hart responded the water project will be completed by the end of October and the road will be patched to get through the winter, with full reconstruction to begin next spring.
Supervisor Meegan stated the project will include installation of bike paths and sidewalks from Leydecker Road to Orchard Park Road.
Nora Mikes questioned if the East & West Road project will be taking residents’ yards for the bike lanes.
Supervisor Meegan responded the town has not seen the plans yet, but it is a county road and a county project. She suggested concerns or comments be voiced to County Legislator Joseph Lorigo or at a county legislative meeting.
Town Attorney John Fenz advised that right-of-ways typically do not stop at the edge of the pavement, which allows the county the right to build upon them.
PUBLIC SECTOR SALARIES
Nora Mikes commented that the public sector should be driven by a desire to serve the public, not by a high salary. She suggested public servants be prepared to make sacrifices or resign from public life to seek employment in the private sector.
PUBLIC MEETINGS
Nora Mikes stated open government groups recommend that citizens be allowed to speak at the beginning of public meetings to allow for their comments to be considered before a vote is taken by the board. She requested the Town Board consider this recommendation.
