Supervisor Wallace C. Piotrowski called the meeting to order at 7:00 P.M. with 30 seconds of silent prayer followed by the Pledge of Allegiance.

Supervisor Piotrowski read the Fire Prevention Code instructing the public where to exit in case of a fire or an emergency.

10-B HELD OVER PUBLIC HEARINGS
1. Re: RENEWAL OF THE CABLE TELEVISION FRANCHISE AGREEMENT BY AND BETWEEN THE TOWN OF WEST SENECA AND TIME WARNER CABLE, in the Town of West Seneca.
Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to renew the cable television franchise agreement by and between the Town of West Seneca and Time Warner Cable.

2. Re: “A REQUEST FOR A SPECIAL PERMIT FOR PROPERTY LOCATED AT 1696 ORCHARD PARK ROAD, BEING PART OF LOT NO. 414, CHANGING ITS CLASSIFICATION FROM R-50 TO R-50(S), FOR A FIVE-UNIT APARTMENT BUILDING” in the Town of West Seneca.

Supervisor Piotrowski advised that the petitioner, Sean Hanley, submitted a letter requesting an adjournment until the next Town Board meeting.
Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to adjourn the public hearing concerning the request for a special permit for property located at 1696 Orchard Park Road until the July 19, 2010 Town Board meeting.

Supervisor Piotrowski advised that the petitioner, George Boller, submitted a revised site plan this date and it had to be reviewed by the Building Department prior to acting on it.

Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to enter into the New York Power Pay Program agreement with Energy Curtailment Specialists, Inc., noting that this program provides financial reward to the town if it is able to use less power during peak demand periods. 3. Town Attorney re Renaming of Centennial Park to Veteran’s Memorial Park |
Motion by Councilwoman Meegan, unanimous second, to adopt the attached resolution renaming Centennial Park to Veteran’s Memorial Park. |
On the question, Councilman Clarke noted that the Centennial Park ball diamond was dedicated in 1973 as George “Spunk” Heusinger Memorial Field and that is not part of the name change to Veteran’s Memorial Park.
Councilwoman Meegan stated that the board members will be meeting with the Veteran’s Committee on July 17th to put together the Veteran’s Memorial Park dedication ceremony that was tentatively scheduled for August 15th.

Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to table this item for review by the Town Attorney. |
On the question, Supervisor Piotrowski stated that Town Attorney Shawn Martin will be reviewing this item to ensure there is proper insurance for the tournament, to determine what income is being generated by the tournament and whether the town should share in that income, and how the tournament will affect the house and travel teams use of the ice rink.

Motion by Supervisor Piotrowski, seconded by Councilwoman Meegan, to approve final change order #1 for Numarco, Inc., 1021 Maple Road, Elma, NY 14059 for a net deduct of $26,905.54 and accept the Spray Pool Water Treatment Project, Job No. S-0902 at a final contract amount of $1352.46. ISSUES OF THE PUBLIC
STATUS OF AMERICORPS DEBT
Karen Lucachick, Greenmeadow Drive, questioned the status of the outstanding AmeriCorps debt.
Comptroller Robert Bielecki advised that an $8000 payment was received on June 9th for the month of June, but nothing on the $75,000 debt.
Town Attorney Shawn Martin stated that he met with former Youth/AmeriCorps Director Mark Lazzara last Friday and had a lengthy conversation concerning a number of issues. He will be discussing this with the Town Board at an Executive Session later in this meeting.
SUGGESTION TO CHANGE NIGHT OF BAND SHELL CONCERTS
Karen Lucachick, Greenmeadow Drive, suggested that the band shell concerts be changed from Monday evenings to a different night due to the lack of parking.
ISSUES OF THE PUBLIC
SUGGESTION TO ELIMINATE SUMMER HOURS
Karen Lucachick, Greenmeadow Drive, understood that summer hours were eliminated in Erie County government and suggested that the town also consider this.
SUGGESTION TO ELIMINATE PEER COUNSELOR POSITIONS
Karen Lucachick, Greenmeadow Drive, referred to a previous suggestion to eliminate the peer counselor positions in the West Seneca School System and asked the board members to seriously consider that elimination.
FLOODING ISSUE ON EAST & WEST ROAD
Joan Solomon, East & West Road, stated that last year a new water line was installed on East & West Road and since then she has had a flooding problem. Mrs. Solomon reported this to the Engineering Department, but was informed that Erie County would have to take care of the problem. The County came out to investigate and told her that something was not done properly with the construction.
Supervisor Piotrowski stated that he would have Town Engineer George Montz look into this and report back to the Town Board.
FLOODING ISSUE ON JASMINE AVENUE
Ken Romance, Jasmine Avenue, asked for assistance with ongoing flooding problems on his street that had recently gotten worse.
Councilwoman Meegan directed Town Attorney Shawn Martin to have Town Engineer George Montz contact Mr. Romance.
Amy Carpenter, Woodward Crescent, commented on the number of sewer problems that are reported to the town and suggested a moratorium on new construction.
SUPPORT FOR PEER COUNSELING PROGRAM
Kaylin Dickey spoke in favor of the Peer Counseling and YES programs and commented on how they have changed her life and her friends’ lives. She suggested that the peer counselors give a presentation to demonstrate the value of these programs.
PRESENTATION OF COMMUNICATIONS BY BOARD MEMBERS AND DEPARTMENT HEADS
“A CHILD IS MISSING” PROGRAM
Chief Gehen announced that the West Seneca Police Department will be getting involved in a program called, “A Child is Missing.” The program deals with reports of missing children, elderly people with dementia issues, and disabled individuals that might wander off. There is a GPS based rapid phone call notification system that will place up to 1000 calls per minute to different localities when activated. A responding officer’s supervisor contacts the program based in Ft. Lauderdale and gives information pertaining to the missing person and records a message that is sent to all the residences within a certain radius of the GPS location. Chief Gehen stated that this was a great program and there was no charge to police agencies. They will begin training on it and have it implemented in approximately one week.
