Supervisor Sheila M. Meegan called the meeting to order at 2:00 P.M. with 30 seconds of silent prayer followed by the Pledge of Allegiance led by Town Attorney Shawn Martin.

Absent - None
Supervisor Meegan read the Fire Prevention Code instructing the public where to exit in case of a fire or an emergency.
The meeting was dedicated to the memory of Kenneth A Bensman and Sister Mary Monica Riordan.
24-A MINUTES TO BE APPROVED
§ Motion by Supervisor Meegan, seconded by Councilman Rusinski, to approve minutes from the 2014 Special Districts & Preliminary Budget of October 24, 2013.

§ Motion by Supervisor Meegan, seconded by Councilman Hart, to approve minutes from the October 28, 2013 work session.

§ Motion by Supervisor Meegan, seconded by Councilman Rusinski, to approve Minutes #2013-23 of October 28, 2013.

24-B COMMUNICATIONS
1. Highway Sup’t. re Purchase requiring Town Board approval

Motion by Supervisor Meegan, seconded by Councilman Rusinski, to authorize the purchase of a new unused 2013 Caterpillar D5K XL from Southworth-Milton at a cost of $106,527 under the piggyback provision outlined in General Municipal Law §103(16), noting that funds are available in the Highway Reserve Fund.

On the question, Councilman Rusinski questioned if this purchase was a replacement.

Highway Supt. Matthew English responded this is a replacement for the current equipment that is 20 years old and has been costing a lot in repairs. They will be keeping the current equipment for use at the transfer station.

2. Town Clerk re DECALS agreement

Motion by Supervisor Meegan, seconded by Councilman Rusinski, to adopt the attached resolution authorizing Town Clerk Jacqueline Felser to execute the NYS Department of Environmental Conservation License Issuing Agent Agreement on behalf of the Town of West Seneca, noting that Town Attorney Shawn Martin has reviewed said agreement.

3. Town Clerk re 30-day period for inclusion of predominantly viable agricultural lands into existing agricultural districts

Motion by Supervisor Meegan, seconded by Councilman Hart, per NYS Agriculture & Markets Law § 303-b, the Erie County Legislature has designated November 1 – 30 as the annual thirty-day period during which landowners may submit requests to include predominantly viable agricultural land into an existing certified agricultural district and copies of the application form have been provided to municipal clerks, assessors and chief elected officials for distribution to interested landowners and is also available on the Department of Environment and Planning website at www.erie.gov/environment.

4. Councilman Hart re Bid award for masonry project at West Seneca Library

Motion by Supervisor Meegan, seconded by Councilman Rusinski, to award the bid for the West Seneca Library Masonry Re-pointing Project to Thomas Johnson Company at their low bid of $17,800, noting that repairs at the library need to begin by December 1, 2013 as a condition of the grant awarded to the town by the State Education Department.

24-C APPROVAL OF WARRANT
Motion by Supervisor Meegan, seconded by Councilman Hart, to approve the vouchers submitted for audit, chargeable to the respective funds as follows:
General Fund - $56,794.50; Highway Fund - $32,604.20; Special Districts - $29,978.82; Capital Fund - $96,250.45 (voucher #’s 80506 - 81165); Trust & Agency Fund - $34,532.08 (voucher #’s 81081 – 81098)

PRESENTATION OF COMMUNICATIONS BY BOARD MEMBERS AND DEPARTMENT HEADS
TRANSFER OF SURPLUS ITEMS TO COUNTY
Motion by Supervisor Meegan, seconded by Councilman Hart, to inventory and transfer to the County of Erie all unused surplus equipment in the storage area at the Senior Citizens Center with the exception of the copiers.
On the question, Supervisor Meegan stated the town has been the beneficiary of several items from the Erie County warehouse (i.e. conference table and chairs in the Detective Bureau, etc.) and this will transfer the town’s unused surplus equipment to the county so other municipalities may benefit.

MORTGAGE DISCHARGE FOR 192 INDIAN CHURCH ROAD
Motion by Councilman Rusinski, seconded by Councilman Hart, to authorize the Supervisor to sign a discharge of mortgage for the mortgage recorded at Liber 8601 of Mortgages Page 446, for 192 Indian Church Road, noting the mortgage was paid in full as of September 12, 1986, the discharge was never filed with the Erie County Clerk, and the property owners are now trying to transfer the property.
On the question, Town Attorney Shawn Martin stated there is also a $50.50 filing fee to file this with the county.

VETERANS DAY CELEBRATION AT SENIOR CITIZENS CENTER
Senior Recreation Therapist of Senior Services Mary Josefiak announced there will be a Veterans Day celebration at the senior citizens center Friday at noon before lunch.

PUBLIC MEETING AT SENIOR CITIZENS CENTER
Councilman Rusinski thanked the board members, department heads and public for attending the meeting concerning Camelot Square Phase III held at the Senior Citizens Center on Wednesday, October 30th, noting that it was productive for the community.
EXECUTIVE SESSION
Motion by Supervisor Meegan, seconded by Councilman Hart, to recess to Executive Session at 2:10 P.M. to discuss personnel matters.

The board members returned from Executive Session at 2:20 P.M.
