1.   Motion by Supervisor Clark, seconded by Councilman Osmanski, that proofs of publication and posting of legal notice: OF A PUBLIC HEARING TO CONSIDER THE FOLLOWING AMENDMENTS TO THE TRAFFIC ORDINANCE AS FOLLOWS: 1) ELIMINATE §115-9A(19); 2) AMENDMENT TO §115-9A(20) ELIMINATE 'A POINT 430' NORTH OF' ON THE WEST SIDE OF DELRAY AVENUE BETWEEN THE CENTER LINE OF GRAHAM AVENUE AND THE END OF THE STREET; 3) ADDITION TO §115-9A(158) 'ON THE SOUTH SIDE OF MAIN STREET BETWEEN A POINT 305' EAST OF THE EAST LINE OF UNION ROAD AND A POINT 485' EAST OF THE EAST LINE OF UNION ROAD'" in the Town of West Seneca, be received and filed.

Motion by Councilman Osmanski, seconded by Supervisor Clark, to open the public hearing.

Delray Avenue - Items #1 & #2

Highway Supt. Pat Finnegan stated that the Traffic Committee had done some background checking and found that these two items were originally requested by West Seneca Fire District #5. The fire commissioners recommended that the town keep one side of Delray Avenue open with no parking permitted.

Bernie Pollutro, 180 Delray Avenue, stated that he surveyed the residents of Delray Avenue and they were all in favor of allowing parking only on the east side from Graham Avenue to the end of the street.

Donald Cieslik, 135 Delray Avenue, stated that there were "No Parking" signs on the east side of the street, but they were not being enforced.

Deputy Town Attorney Bill Bond stated that if these proposals passed, parking would be prohibited on the west side of Delray Avenue between Graham Avenue and the end of the street, but would be allowed on the east side.

Main Street - Item #3

Highway Supt. Pat Finnegan stated that the Traffic Committee had no problem with eliminating parking on Main Street between the Ebenezer United Church of Christ parking lot entrances.

Harold Ulrich, 75 Norwood Drive, commented on the current problem with cars exiting onto Main Street that could not see the traffic coming from Union Road.

Motion by Councilman Osmanski, seconded by Supervisor Clark, to close the public hearing.

Motion by Supervisor Clark, seconded by Councilman Osmanski, to adopt the following amendments to the Traffic Ordinance: 1) eliminate §115-9A(19); 2) amendment to §115-9A(20) eliminate 'a point 430' north of' on the west side of Delray Avenue between the center line of Graham Avenue and the end of the street, in the Town of West Seneca.

1.   Supervisor Clark re Application to New York State Department of Labor

Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to authorize Supervisor Paul T. Clark of the Town of West Seneca to file an application for funds from the New York State Department of Labor, Occupational Safety and Health Training and Education Grant program requesting $12,540 to support a health, hazard and safety awareness training program that will benefit town employees, noting that the town will match grant funds with $51,010 in in-kind goods and services or 80 percent of the total project cost of $63,550.

2.   Town Attorney re 2002 STOP DWI contracts

Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to authorize the Supervisor to execute the 2002 STOP DWI agreement that covers reimbursement to the town for police work and court processing.

3.   Town Engineer re Award of survey work for easement acquisition for ice retention structure

Motion by Councilman Osmanski, seconded by Councilman Graber, to award the survey work for easement acquisition for the ice control structure to TVGA Consultants, 1000 Maple Road, Elma, NY 14059 at their low proposal amount of $37,200.00, noting that the base bid was increased approximately $1500 for expenses (monuments) and $9000 for legal descriptions for the individual parcels (approximately 60 @ $150 each).

4.   Highway Supt. re Purchases requiring Town Board approval

Motion by Councilman Osmanski, seconded by Councilman Hicks, to authorize payment of $4840 to Suburban Plumbing for repairs to the hot water tank at the Highway Department and $5065.35 to Fleet Maintenance for truck repairs.

5.   Chief Gehen re Bid date for purchase of mobile data terminals

Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to set a bid date of February 10, 2003 at 10:00 A.M. for receipt of bids on the purchase of eight (8) Panasonic Ruggedized Model 28 laptop computers with backlit keyboards, noting that 75 percent of this purchase would be covered by the COPS MORE 2002 grant and the remaining 25 percent was a required match that would be covered by the 2002 police equipment bond.

6.   Chief Gehen re Purchase of semi-automatic pistols

Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to authorize the purchase of seventy (70) Glock, Model 22 FGR .40 caliber, semi-automatic pistols, TNS, 3 LE mags, 5 pound trigger pulls for a total cost of $3618 from Glock Inc., P.O. Box 389, Solvay, NY 13209, noting that this price included trade-in of all older semi-automatic pistols and the cost of the expenditure would be covered by the 2001 Local Law Enforcement Block Grant.

7.   Chief Gehen re Status change for Melissa Hender to part-time seasonal

Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to change the status of Senior Clerk Melissa A. Hender from part-time to part-time seasonal effective February 1 - March 31, 2003 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

8.   Chief Gehen re Resignation of David Gick as part-time Public Safety Dispatcher

Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to accept the resignation of David J. Gick and terminate him as part-time Public Safety Dispatcher effective January 16, 2003 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

9.   Chief Gehen re Appointment of Michael Rybak as part-time Public Safety Dispatcher

Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to appoint Michael G. Rybak as part-time Public Safety Dispatcher at a rate of $8.95 per hour effective January 28, 2003 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

10.   Chief Gehen re Purchase requiring Town Board approval

Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to authorize payment of $3040 to Al Ross Sport Screening for DARE t-shirts.

11.   Town Clerk re Records Management grant application Town Clerk re Computer purchase

Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to adopt the following resolution regarding the 2003-2004 Records Management Grant application:

WHEREAS, the Town of West Seneca desires to obtain grant funds available under the Local Government Records Management Improvement Fund for the purpose of enhancing our existing web site with on-line forms, on-line database search of vital records, and creation of an electronic mailing list group, now, therefore, be it

RESOLVED, that Supervisor Paul T. Clark is hereby authorized to execute the necessary documents to apply for funding in the amount of $5939 to the New York State Education Department, State Archives and Records Administration to enable the town to enhance the existing web site with on-line forms, a vital statistics database, a LISTSERV, and website training, noting that the town will match grant funds with $15,690 in in-kind goods and services, or 73 percent of the total project cost of $21,629.

On the question, Supervisor Clark stated that this was a big step in technology for the Town of West Seneca, and he thanked Town Clerk Patricia Wisniewski and her staff for their work in this regard. This helped to open up government to the people and many residents had come to expect it.

12.   Town Clerk re Computer purchase

Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to authorize the purchase of an HP EVO D310 P4/2.0Ghz processor and Samsung 19" 101T LCD monitor with warranty uplifts from IKON at a total cost of $1711.

13.   Town Clerk re Purchase requiring Town Board approval

Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to authorize payment of $2674 to West Seneca Printing Inc., 860 Center Road, West Seneca, for printing of the 2003 Town of West Seneca historical calendars.

14.   Receiver of Taxes re Extension of warrant for 2003 town/county tax collection

Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to approve an extension to the warrant for the 2003 Town/County tax collection from April 30, 2003 to June 30, 2003, noting that this would allow any penalties collected during May and June to be payable to the Town of West Seneca and not to the county.

15.   Youth Director re Purchase requiring Town Board approval

Motion by Councilman Osmanski, seconded by Councilman Hicks, to authorize payment of $6955.78 to NASCC Forum for attendance of Youth Director Mark Lazzara, Dan Frontera, James Lawson, Beth Simons & Donna Cullens at the NASCC Conference in Washington DC, February 9 - 12, 2003.

PRESENTATION OF COMMUNICATIONS BY BOARD MEMBERS AND DEPARTMENT HEADS

MILITARY LEAVE OF ABSENCE FOR WILLIAM GEARY

Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to approve a military leave of absence for William Geary effective January 29 - February 6, 2003 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

APPOINTMENT OF DOG CONTROL OFFICERS O'NEIL & KERNER AS CONSTABLES

Motion by Councilman Hicks, seconded by Supervisor Clark, to appoint Dog Control Officer William O'Neil & Asst. Dog Control Officer Al Kerner as Constables for the purpose of enforcing Article 26 of the NYS Agriculture & Markets Law and pursuant to Town Law §158 and C.P.L. §2.10 (54).

On the question, Supervisor Clark stated that after some training this would allow Mr. O'Neil and Mr. Kerner the ability to issue appearance tickets for animal cruelty violations that were becoming more prevalent around Western New York.

ATTENDANCE OF COURT CLERK B. PARISI AT TRAINING PROGRAM

Motion by Supervisor Clark, seconded by Councilman Wroblewski, to authorize Traffic Court Clerk Barbara Parisi to attend the Association of Towns training program in New York City, February 16 - 19, 2003 at a cost not to exceed $1300.

On the question, Supervisor Clark stated that Mrs. Parisi was the Vehicle & Traffic Clerk for both courts and there were a number of changes in how these tickets were handled in New York. The Judges had requested that an additional clerk attend this year's conference only due to the specialized training that was being offered. This specialized training would not be offered locally for some time and would impact on Mrs. Parisi's work in the Justice Court.
