3. Town Attorney re Water Supply Agreement with Orchard Park Water District No. 15
Motion by Councilman Osmanski, seconded by Councilman Hicks, to authorize the Supervisor to execute an agreement between West Seneca Water District No. 3 and Orchard Park Water District No. 15 for the provision of water services by Orchard Park Water District No. 15 to West Seneca Water District No. 3, noting that this agreement allows Orchard Park Water District No. 15 to provide water along Southwestern Blvd. in the area of the new YMCA and West Seneca Water District No. 3 pays for the actual water used plus a contribution towards any new capital costs in Orchard Park Water District No. 15 and the final form of agreement will be subject to approval by the Town Attorney.

PROBLEMS OF THE PUBLIC
CLASSROOM FACILITY AT SENIOR CITIZEN CENTER FOR AMERICORPS
Erich Vogel, 3663 Seneca Street, President of West Seneca Senior Citizens Board of Directors, stated that when the senior citizens center was built it was designated that the upstairs would be for senior citizens use and the downstairs for social groups to meet and conduct their social activities. Mr. Vogel understood that the boy scouts and other social groups that were meeting there were recently evicted to make room for the AmeriCorps. He did not believe that the AmeriCorps was a social group of West Seneca; they were a federally funded agency that used West Seneca as their base of operation. Mr. Vogel stated that when the Burchfield Center was built, part of the building was supposed to be for AmeriCorps offices. He questioned why they were not using the Burchfield Center and were encroaching on the senior citizens center.
Supervisor Clark stated that there were town facilities in a good portion of the upstairs of the senior citizens center. The downstairs portion was known as the "community center" and it would continue to be a facility for many groups of people who wanted to meet for a variety of interests. The auxiliary police and police officers' union both had offices on the lower floor of the building and the town also stored its inactive records in one of the rooms. Supervisor Clark stated that they had to juggle some of the groups that met in the downstairs in order to accommodate a classroom training facility that could be used by groups including but not limited to the AmeriCorps. The scouting groups that were displaced would be relocating to the Kiwanis Youth Center, and the clogging groups would be able to keep their same schedule at the senior citizens center. accommodations for their meetings were a swimming group and a quilting group. Supervisor Clark commented that the AmeriCorps program offered "Operation Giveback" to the senior citizens of the community in which they shoveled sidewalks, ran errands, raked leaves, etc. and gave thousands of hours of service. He thought they were a very good and highly supervised group of individuals, and they wanted to give the members some training so they could continue on after their service time was completed. Town employees supervised the program and ran a tight ship. They did not have the square footage in the Burchfield Center to accommodate a classroom facility. Supervisor Clark thought that the AmeriCorps program was a good program for the Town of West Seneca, and although they did work in other communities and attracted members from many communities, it was still a West Seneca program. They received a lot of money for the program from the federal government and almost all of it was used for direct supplies, living allowance and hospitalization insurance for members, and college vouchers after the members served for one year. There was not enough leftover to rent office space and there was no other space available. Supervisor Clark thought that the AmeriCorps had improved the quality of life for many in the community through their contributions, and the space allocated to them at the Senior Citizens Center was warranted.
Mr. Vogel expressed concern that the AmeriCorps members would be running in and out of the facility all day and cause a disturbance at the Senior Citizens Center. He hoped that their use of the facility would be limited to the classroom purpose and that they would not infringe on the seniors in the future.
Supervisor Clark responded that the board members would remove the AmeriCorps from the facility if that were to occur. He asked that Mr. Vogel report to the board any inappropriate activity at the Senior Citizens Center.
Mr. Vogel further commented on the condition of the roof at the Senior Citizens Center and asked that it be replaced. Each year the roof was patched, but it continued to leak and cause damage within the building. Mr. Vogel thought it would be cheaper to replace the roof than continue patching it.
Supervisor Clark thought that they had allowed for roof replacement in the 2002 budget under bonding for major capital improvements. They would only have to get through this winter and look forward to improvements in the spring.
RESIDENT QUESTIONS STATUS OF SONY THEATER & REQUESTS BENCHES IN TOWN
Dominic Conorozzo, 20 Klink Place, questioned the status of the Sony theater that had been proposed for the former Seneca Mall site and commented on a need for more recreation in West Seneca. He also suggested that the town consider placing benches around the town for those who travel by foot, especially in the Union Road and Main Street area.
Supervisor Clark thought that it would be good to provide benches for the public and asked that Deputy Highway Supt. Ed Kowalewski price some benches for along the Town Hall complex. Due to easements, maintenance, and expense it would be difficult to place benches throughout the town. However, there were places to relax in the various parks that were constructed such as Burchfield and the soccer complex. With regard to the Sony Theater, Supervisor Clark advised that the contract fell through and the proposal was placed on hold indefinitely. Private developers owned the property, but the town was working very hard with them.
SNOW REMOVAL ON SIDEWALKS
Barbara Wrobel, 345 Allendale Road, questioned the status of the snowplowing ordinance for the sidewalks on the Union Road corridor, where they stood with the Americans With Disabilities Act (ADA), and how the insurance company for the town felt about the situation.
Supervisor Clark stated that the board intended to address the issue at this meeting and were prepared to act on it. He had not heard any concerns from the ADA prior to this and the town was self-insured so there were some liability concerns.
