4. Supervisor Clark re Grant application for water quality improvement projects
Motion by Councilman Wroblewski, seconded by Councilman Graber, to authorize Supervisor Paul T. Clark to submit an application to the New York State Department of Environmental Conservation, Water Quality Improvement Projects (Waste Treatment Improvement) requesting $12,500 under the Clean Water/Clean Air Bond Act of 1996 to upgrade the town's Union Road pump station with the replacement of two pumps, control systems, and attendant plumbing and electrical work, noting that the town would contribute $12,500 in cash and in-kind goods and services or 50 percent of the total project cost of $25,000.

6. Town Attorney re Negative declaration for West Seneca Commercial Center, LLC
Motion by Councilman Graber, seconded by Councilman Hicks, to issue a negative declaration with regard to the West Seneca Commercial Center LLC project located at 30 North America Drive.
On the question, Supervisor Clark stated that he would be abstaining from voting on this motion because West Seneca Commercial Center LLC was a client of an accounting firm that he had a financial interest in.
Town Attorney Tim Greenan advised that the negative declaration was required because West Seneca Commercial Center LLC had applied to the Erie County Industrial Development Agency (ECIDA) for financing. The ECIDA requested that the town review the project under SEQR.

On the question, Councilman Wroblewski noted that along with the revenue from this sale, the property would also be placed back on the tax rolls and generate additional revenue in the form of property taxes.

Youth Director re State contract bid for Distance Learning Grant (continued)On the question, Supervisor Clark thanked Senator Stachowski for providing this grant money and stated that the equipment would be used to provide remote learning opportunities for AmeriCorps personnel, school children who visit the Burchfield Center and others who attend classes there.

REGIONALISM APPROACH TO PURCHASING WITH W.S. SCHOOL DISTRICT
Councilman Wroblewski had spoken with some members of the West Seneca School Board regarding regionalism and asked that Comptroller Chuck Koller discuss with the School District Treasurer the possibility of purchasing some items in bulk at a cost savings.
UPDATE ON SENECA MALL SITE CLEAN-UP
Councilman Wroblewski requested an update on the status of the Seneca Mall site.
Building Inspector Bill Czuprynski advised that everything at the site had been cut and the fences and signs were repaired. The property owner had done everything they had been asked to do.
Councilman Wroblewski stated that another complaint with regard to the site was the mounds of dirt. He understood that because of the zoning of the property the town could not force the owner to knock down the dirt piles. Councilman Wroblewski questioned if the property could be rezoned or if there was any other way they could order that the dirt piles be taken down.
Town Attorney Tim Greenan understood that there was stockpiling of stone and that was permissible in an M-1 zoning district, but the piles of rubbish and debris along Slade Avenue would not be permitted. The Town Board had the authority to rezone the property from M-1 to C-2, but the property owner could sue the town if they could show that it caused a decrease in the value. Mr. Greenan stated that he would forward this request to Dave Lawrence of the West Seneca Development Corporation and Jim Lawson who was working on the master plan for the town.

Mr. Czuprynski stated that the piles along Slade Avenue were put there because they had planned to construct a two-story building on that side of the property. He did not know whether the plans had fallen through for this store but would contact the owner again. Mr. Czuprynski thought that they would be receptive to knocking down the piles.

ALTERNATE PARKING PROPOSAL FOR EDSON STREET
Councilman Graber requested that Highway Supt. Pat Finnegan and the Traffic Safety Committee review the parking situation on Edson Street. Currently parking was only allowed on one side of Edson Street. This created a problem in the winter with snowplowing because that side never got plowed. The residents suggested alternating parking from one side to the other.
Mr. Finnegan requested the name of a contact person from Edson Street and noted that his department would go into the neighborhood with highlifts after a snow event and did not often receive cooperation from the residents with moving their vehicles. He would have the Traffic Safety Committee review the Edson Street parking situation.
YIELD SIGN ON W. CRANWOOD DRIVE
Councilman Graber referred to Highway Supt. Pat Finnegan and the Traffic Safety Committee a concern from a resident of W. Cranwood Drive. The resident thought that the yield sign on W. Cranwood Drive created a hazardous situation and requested that it be replaced with stop signs on all sides.
