5.   Town Engineer re Purchase requiring Town Board approval

Motion by Councilman Osmanski, seconded by Councilman Graber, to authorize payment of $3205 to URS Greiner, Inc. for preparation of discharge monitoring reports.

6.   Highway Supt. re Title change for Thomas Bausch to Working Crew Chief

Motion by Councilman Wroblewski, seconded by Councilman Graber, to terminate Thomas Bausch as Heavy Equipment Operator and appoint Thomas Bausch as Working Crew Chief at a rate of $20.40 per hour, Group 6, Step 5, effective March 12, 2001 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

7.   Highway Supt. re Military leave of absence for Darryl Seibert

Motion by Councilman Osmanski, seconded by Councilman Graber, to grant a military leave of absence for Darryl Seibert effective February 25 - March 9, 2001 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

8.   Highway Supt. re Purchase requiring Town Board approval

Motion by Councilman Osmanski, seconded by Supervisor Clark, to authorize payment of $3232.54 to Schaub Equipment Rental for tractor parts.

Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to approve the application for a 2001 C.O.P.S. M.O.R.E. grant from the United States Department of Justice in the amount of $98,428 and authorize the Supervisor to sign the appropriate paperwork.

On the question, Councilman Osmanski stated that the requested funds would be used to purchase thirteen (13) laptop computers to upgrade aging equipment in the patrol cars and for upgrading the police records management computer system. Included in the request was the town's 25 percent match of $24,607.

Councilman Wroblewski commended Chief Miskovski for finding and applying for this grant and noted that these improvements would have to be made whether or not the funds were received.

10.   Chief Miskovski re Purchase requiring Town Board approval

Motion by Councilman Osmanski, seconded by Councilman Graber, to authorize payment of $3920 to Al Ross Sports Screening for D.A.R.E. shirts and hats.

11.   Chief Miskovski re Designation of National Night Out

Motion by Councilman Wroblewski, seconded by Councilman Graber, to designate Tuesday, August 7, 2001 as National Night Out in the Town of West Seneca, noting that this event will be held at the Southgate Plaza with the cooperation and assistance of the Buildings & Grounds Department in setting up and dismantling any needed equipment.

12.   Town Clerk re Purchase requiring Town Board approval

Motion by Councilman Osmanski, seconded by Councilman Graber, to authorize payment of $2623 to Brown's River Bindery, Inc. for preservation treatment and rebinding of vital records books, noting that funds are available under the Historical Preservation Expense Line Item #1.1410.0426.

13.   Town Clerk re Purchase requiring Town Board approval

Motion by Councilman Graber, seconded by Councilman Wroblewski, to authorize payment of $1775.80 to Biel's Information Tech Systems for microfilming of building permits, noting that funds are available under the microfilming grant.

14.   Receiver of Taxes re Budgetary transfer request

Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to approve a budgetary transfer of $500 from Postage Acct. #01.1330.0411 to Other Expenses Acct. #01.1330.0419.

15.   Youth Director re Attendance of M. Lazzara & E. Simons at National Family Literacy Conference

Motion by Councilman Osmanski, seconded by Councilman Hicks, to authorize Mark P. Lazzara and Elizabeth Simons to attend the National Family Literacy Conference in Dallas, Texas, March 18 - 20, 2001 at a cost not to exceed $2000 from the AmeriCorps grant and approve an advance payment for these expenses.

    APPROVAL OF MINUTES & AWARD FOR TWO (2) FOUR-WHEEL DRIVE VEHICLES

    Motion by Councilman Hicks, seconded by Councilman Graber, to award the bid for the lease of two (2) four-wheel drive vehicles to Gillogly Chevrolet, 1777 Union Road, West Seneca, at their low bid price of $414.13 per vehicle, per month for 36 months.

    On the question, Councilman Wroblewski stated that many vehicles purchased by the town went to out-of-town dealers who were the lowest bidders. He was happy to see that a West Seneca dealer, Gillogly Chevrolet, was finally able to come up with the lowest bid.

    PURCHASE REQUIRING TOWN BOARD APPROVAL

    Motion by Supervisor Clark, seconded by Councilman Osmanski, to authorize payment of $1605.90 to Manpower, Inc. for temporary clerical help in the Youth Bureau.

    WEST SENECA POLICE DEPARTMENT 2000 ANNUAL REPORT

    Supervisor Clark acknowledged receipt of the West Seneca Police Department's annual report for the year 2000 which outlined almost every facet of the police department. He noted that the number of police calls had increased and the number of fire and EMS calls remained approximately the same at 3000.

    NEGATIVE DECLARATION FOR PATIO HOME PROJECT

    Motion by Supervisor Clark, seconded by Councilman Osmanski, to amend the minutes of the November 13, 2000 Town Board meeting and issue a Negative Declaration as part of the approval of the rezoning and special permit for part of Lot Nos. 294, 295 & 309 for a patio home project.

    AMENDMENT TO YOUTH BUREAU TRAVEL POLICY

    Motion by Supervisor Clark, seconded by Councilman Osmanski, to modify the Youth Bureau travel policy to indicate that nothing in the policy shall prohibit the respective appropriate parties from approving an advance of funds.

    On the question, Town Attorney Tim Greenan stated that this would allow Youth Director Mark Lazzara to approve an advance of funds if the cost of travel were under $700 per person, or the Youth Director and Town Board Liaison to approve an advance if the cost were $700 to $1300 per person.

    RECONSTRUCTION AND WIDENING OF I-90

    Supervisor Clark stated that he had recently attended a community meeting relative to the widening of I-90. The NYS Thruway Authority awarded the project and it was about ready to begin. As a result of the widening, the residents of Emporium Avenue would be even more affected by the thruway and they aired their concerns at the meeting. Supervisor Clark thought that the widening would be an improvement to the town because it would eliminate stop and go traffic on the I-90 during peak periods of travel. He suggested that they petition the NYS Thruway Authority with respect to the contract that was already awarded.

    RECONSTRUCTION AND WIDENING OF I-90    (continued)

    Motion by Supervisor Clark, seconded by Councilman Osmanski, that the Town of West Seneca respectfully requests the following considerations from the NYS Thruway Authority with regard to the reconstruction and widening of I-90:

    1. Build up of a higher berm beneath the 12-foot wooden visual fence barrier that is to be installed, especially in the middle section of Emporium Avenue where the land is at its lowest point at grade level with respect to the I-90;
    2. The contract be modified to allow for a two-year warranty on all landscape as opposed to the presently existing one-year;
    3. More plantings of a sturdier and more deciduous nature be installed, possibly as much as 20 percent more;
    4. The Thruway Authority forward written notice to the town as to what their work hours will be, understanding that they will not be later than 11:30 P.M.

    and further, that the Town Clerk is directed to forward certified copies of this resolution to Governor Pataki; members of the NYS Assembly and Senate in the Buffalo area; William Leslie, Division Engineer for the NYS Thruway Authority in Buffalo; John Platt, Executive Director of the NYS Thruway Authority in Albany; and Public Information Officer Brian Rusk.

    On the question, Councilman Graber stated that this was not the first time that the town had involved itself in this project. They had previously requested time limits on the construction and sound barriers on a number of occasions. Councilman Graber commented that the Town Board had been fighting the Thruway Authority to do the job right and this resolution would document their past concerns and additional concerns that were brought up at the meeting.

    REQUEST FOR SUPPORT OF ICE RETENTION STRUCTURE IN CAZENOVIA CREEK

    Motion by Supervisor Clark, seconded by Councilman Osmanski, to adopt the following resolution with regard to the Cazenovia Creek ice retention project, noting that the Town of West Seneca has approved a bonding resolution for this project for the town's share and is requesting aggressive and continuous work on the project and budgetary restrictions for project funding:

    RESOLVED, that the Town of West Seneca petition the U.S. Army Corps of Engineers and the NYS Department of Environmental Conservation for the insurance of funding and design and contract work for the Cazenovia Creek ice retention project.

    On the question, Supervisor Clark directed Town Clerk Patricia Wisniewski to forward a certified copy of this resolution to Congressmen Quinn, LaFalce and Reynolds; Senators Schumer and Clinton; Lt. Col. Glen DeWillie, District Commander of the U.S. Army Corps of Engineers; Ted Meyers, Environmental Engineer with the NYS Department of Environmental Conservation in Buffalo; Erin Crotty, Acting Commissioner of the NYS Department of Environmental Conservation in Albany; Ron Hayes, Director of Community Development for Congressman Quinn; and Jim Keane, Senator Clinton's Chief of Staff in Buffalo.

    Councilman Osmanski commented on the past cooperation and efforts of the Army Corps of Engineers and Department of Environmental Conservation in working with the town and suggested that this be expressed in the communication.
