Supervisor Paul T. Clark called the meeting to order at 7:30 P.M. with 30 seconds of silent prayer followed by the Pledge of Allegiance.

    Town Attorney Tim Greenan read the recommendation of the Planning Board: "At its May 15, 2002 meeting, the Planning Board recommended approval of the request for a rezoning and special permit for property located at 450 Bullis Road, being part of Lot No. 363, changing its classification from R-75A to R-50(S), for a three-family home."

    The petitioner, Alene Roll, 450 Bullis Road, stated that she would like to convert her two-car garage and family room into a third apartment that would be completely handicapped accessible. She would reside in the new apartment and her son would live in one of the other units.

    No comments were received from the public.

    Motion by Councilman Osmanski, seconded by Councilman Wroblewski, to authorize the Supervisor to execute the 2002 agreement between the Town of West Seneca and the Western New York Umpires' Association at a cost of $31 per man, per game officiated, noting that this is the same cost as last year.

    2.   Town Engineer re Bid date for 2002 Sanitary Sewer Rehabilitation Project

    Motion by Councilman Osmanski, seconded by Supervisor Clark, to set a bid date of July 8, 2002 at 10 A.M. for receipt of bids on the 2002 Sanitary Sewer Rehabilitation Project, Job No. S-0201, noting that the project includes lining of sanitary sewers, grouting house laterals and sealing manholes in various areas of town to minimize infiltration and surcharging in the sanitary sewer system.

    On the question, Councilman Wroblewski asked Principal Engineer Assistant Gary Bommer for a brief synopsis of how this project worked and how it benefited the town.

    Mr. Bommer responded that slip lining the sewers was done with a very thin pvc pipe that was expanded using hot water to make it conform to the shape of the original pipe. This reduced the size of the pipe by about ¼-inch, but increased the flow considerably. Five to ten feet of each sanitary sewer lateral was also lined to seal them along with the manholes. Mr. Bommer commented that this procedure had cut the infiltration down dramatically.

    Motion by Councilman Osmanski, seconded by Supervisor Clark, to authorize the Supervisor to sign the county signal permit for Slade Avenue at the Hampton Inn/Shops at West Seneca roadway.

    4.   Town Engineer re County traffic signal permit for Seneca Street at Hilldale Avenue

    Motion by Councilman Osmanski, seconded by Councilman Hicks, to authorize the Supervisor to sign the county signal permit for Seneca Street at Hilldale Avenue and the soccer complex.

    5.   Town Engineer re Hydrant additions in WS Fire District #3 - Queen's Grant subdivision

    Motion by Councilman Osmanski, seconded by Councilman Hicks, to approve the additional annual hydrant fee of $2978.04 (13 @ $229.08 each) to Erie County Water Authority for addition of thirteen hydrant and valve assemblies in the proposed Queen's Grant subdivision, noting that the additional hydrants would be installed by the developer at no cost to the town.

    6.   Town Engineer re Termination of Nicholas Englert as part-time seasonal laborer in Sewer Service Dept.

    Motion by Councilman Osmanski, seconded by Councilman Hicks, to terminate Nicholas Englert as part-time seasonal laborer in the Sewer Service Department effective June 10, 2002 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

    11.   Highway Supt. re Rate increase for part-time laborer Dan McParlane

    Motion by Councilman Osmanski, seconded by Supervisor Clark, to grant a $.75 increase to Dan McParlane, part-time laborer in the Bldgs. & Grounds Department, and set his rate of pay at $7.25 per hour effective May 31, 2002 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel, noting that Mr. McParlane completed the 2500 hours necessary for this increase.

    12.   Highway Supt. re Bid award for roof replacement at Senior Citizens Center

    Motion by Councilman Osmanski, seconded by Councilman Hicks, to award the bid for roof repair at the Senior Citizens Center to Sahlem's Roofing at their low bid price of $98,260.

    On the question, Councilman Wroblewski questioned if the town was successful in obtaining funding through FEMA.

    Supervisor Clark responded that they had received preliminary approval from FEMA for the funding, but 12½% of the cost would come from the town contingency fund. There was no insurance coverage for ice and snow damage.

    Councilman Hicks was happy to see the bid awarded to Sahlem's Roofing, a local contractor who was also the low bidder on the project.

    13.   Highway Supt. re Bid award for purchase of brush chipper

    Motion by Councilman Osmanski, seconded by Councilman Hicks, to award the bid for purchase of a brush chipper to Baschmann Services, 1101 Maple Road, Elma, NY 14059 at their bid price of $19,950.

    On the question, Supervisor Clark stated that Baschmann Services was the only bidder on this equipment, and although they were reluctant to award a bid to a single bidder, the bid price was the budgeted amount and the equipment was needed. He also did not believe the low price of the equipment warranted a rebid.

    Councilman Wroblewski understood that this was a used piece of equipment and Highway Supt. Pat Finnegan had expected to pay about $30,000 for a new brush chipper. Mr. Finnegan inspected the equipment and found it to be in almost new condition.

    14.   Chief Gehen re Network upgrade

    Motion by Councilman Osmanski, seconded by Supervisor Clark, to authorize payment of $1865.63 to Synchronet Industries Inc., 2430 North America Drive, West Seneca, for professional support services and installation of the new NetWare v5.1 server in the Police Department.

    15.   Chief Gehen re Appointment of James Loga as Police Lieutenant

    Motion by Councilman Osmanski, unanimous second, to terminate James K. Loga as Detective Temporary effective June 10, 2002 and appoint James K. Loga as Police Lieutenant effective June 11, 2002 at an annual salary of $62,440.00 and authorize the Supervisor to complete and sign the necessary forms for Erie County Personnel.

    On the question, Supervisor Clark congratulated Officer Loga and commented that he was a commendable police officer with an extensive educational background.

    Councilman Osmanski commented that Officer Loga showed excellent leadership qualities both as a patrol officer and as head of the PBA working with the town in a progressive way to make advancements in the Police Department.

    16.   Tax Receiver re Sale of used monitor

    Motion by Councilman Osmanski, seconded by Supervisor Clark, to approve the sale of a monitor no longer being used in the Tax Office for the sum of $25.

    21.   Grantwriter re Authorizing resolutions for parks grants

    Motion by Supervisor Clark, seconded by Councilman Osmanski, to authorize and direct Paul T. Clark, Supervisor of the Town of West Seneca, to file an application for funds from the New York State Office of Parks, Recreation and Historic Preservation in accordance with the provisions of Title 9 of the Environmental Protection Act of 1993, in an amount not to exceed $5,796 and upon approval of said request to enter into and execute a project agreement with the State for such financial assistance to this Town of West Seneca for the construction of an outdoor ice rink at the Seneca Street Soccer Park, noting that the Town of West Seneca will match the New York State Office of Parks, Recreation and Historic Preservation funds with $31,200 in cash and in-kind goods and services.

    On the question, Supervisor Clark stated that the town had conducted studies and already ordered and purchased some of the materials for an outdoor ice rink at the soccer park. They were hoping to receive some grant funds to help get things set up and running. The town's match would consist of excess manpower available at that time along with utilities and the cost of some of the capital at the facility.

    Motion by Supervisor Clark, seconded by Councilman Osmanski, that the Town Park and Recreation Master Plan originally adopted at a regular meeting of the Town Board in June 1995 and revised in April 1996, has been reviewed, reaffirmed, and is in effect as the guiding document for the acquisition, preservation and development of open space in the town.

    Motion by Supervisor Clark, seconded by Councilman Osmanski, to authorize and direct Paul T. Clark, Supervisor of the Town of West Seneca, to file an application for funds from the New York State Office of Parks, Recreation and Historic Preservation in accordance with the provisions of Title 9 of the Environmental Protection Act of 1993 or Title 3 of the Clean Water/Clean Air Bond Act of 1996, in an amount not to exceed $39,999 and upon approval of said request to enter into and execute a project agreement with the State for such financial assistance to the Town of West Seneca for the construction of a trail in Knox Park, noting that the Town of West Seneca will match grant funds with $40,000 in cash and in-kind goods and services.

    Motion by Supervisor Clark, seconded by Councilman Osmanski, to authorize and direct Paul T. Clark, Supervisor of the Town of West Seneca, to file an application for funds from the New York State Office of Parks, Recreation and Historic Preservation in accordance with the provisions of Title 9 of the Environmental Protection Act of 1993, in an amount not to exceed $5850 and upon approval of said request to enter into and execute a project agreement with the State for such financial assistance to this Town of West Seneca for the construction of an environmental classroom at the Charles E. Burchfield Art and Nature Center, noting that the Town of West Seneca will match the New York State Office of Parks, Recreation and Historic Preservation funds with $5850 in cash and in-kind goods and services.
