Small Claims

Small claims, evictions and civil filings are being accepted at the Court Clerk's Office, room 206. 

Small Claims is an informal court where individuals can sue for monetary damages only up to $3,000 maximum in the Town and Village Court. Claims over $3000 but not exceeding $5,000 can be directed to a City Court. The person or business you are suing MUST reside or have an office for business in the Town of West Seneca.

To start a small claim, you must come to the Court Office and complete a small claims application in which you will need the name and address of the party to be sued and the exact dollar amount. A filing fee of $10 is required for claims up to $1,000. A $15 fee is required for claims $1,000 to $3,000. A future court date will be scheduled.
