Chairman Robert Niederpruem Jr. called the meeting to order at 7:00 P.M. followed by the Pledge to the Flag.

Chairman Niederpruem read the Fire Prevention Code instructing the public where to exit in case of a fire or other emergency.
APPROVAL OF PROOFS OF PUBLICATION
 
          Motion by Mendola, seconded by Rathmann, to approve the proofs of publication and posting of legal notice.

APPROVAL OF MINUTES
 
          Motion by Rathmann, seconded by Greenan, to approve Minutes #2010-12 of December 9, 2010.

A request from John Lattanzio for a home occupancy permit for property located at 736 Union Road, being part of Lot No. 329 for a portrait studio.
 
          Chairman Niederpruem stated in addition to the application, the Board has received a survey and a layout of the building as being proposed.
         
          John Lattanzio stated he and his son are purchasing the property. His son will be living on the premises and does photography as a hobby. He would like to place a sign for the portrait studio portion of the property.

          Mr. Niederpruem indicated that the plan shows 378 sf for the portrait studio. He noted this was formerly a doctor’s office and is actually two stories.
 
          Mr. Lattanzio stated that was correct.
 
          Mr. Niederpruem questioned whether there will be other improvements to the site.
 
          Mr. Lattanzio stated the house need repairs, including all new windows. There is no ventilation for the roofing and may have to remove the entire top of the house to provide overhangs and ventilation. A two-car attached garage may also be added to the rear. The property will be used more for living than business.
 
          Mr. Niederpruem noted 7 parking spaces were indicated with 1 handicapped space and questioned if there will be any improvements to the parking lot.
 
          Mr. Lattanzio stated the parking lot is existing blacktop.
 
          Mr. Mendola asked where the entrance to the studio will be located and questioned if the exterior of the building will be changed.
 
          Mr. Lattanzio stated the entrance will be located on the East & West side of the building where it currently exists for the doctor’s office and the exterior of the building will remain as it is.
 
          Mr. Martin noted that any changes to the exterior would have to comply with the building code; otherwise, a variance would be required.
 
          Mr. Mendola noted that lighting is important and should not be intrusive to neighbors on East & West Road.
 
          Mr. Lattanzio stated the lighting will most likely be flood lights off the back of the house where the parking lot is situated and work on a motion detector.
 
          Mr. Gullo noted he observed two residential flood lights on the back illuminating the parking lot that do not appear to be obtrusive; there is also a fence abutting the west property line.
 
          Mr. Lattanzio stated this is more or less a hobby for his son and by appointment only; no more than one or two couples a week.
 
          Mr. Ciancio cautioned petitioner that the regulations of the home occupancy permit must be followed or the home occupancy permit can be rescinded.

          Mr. Mendola questioned the need for any change in the fencing around the property.
 
          Mr. Gullo stated there is sufficient fencing along the north and west lot lines.
 
          Mr. Greenan noted this property has been zoned R-75 as a professional office for a number of years. The neighbors are accustomed to this exception to the R75 zone and to his knowledge there are no objections. There is an attorney’s office across the street. The property on the corner across the street is owned by Ralph Lorigo and cannot be utilized due to the underground condition which does not allow for a basement.
 
Motion by Greenan, seconded by Ciancio, to approve the request for a home occupancy permit for property located at 736 Union Road, being part of Lot No. 329 for a portrait studio.
